2. Account Registration and Security

3. Service Description

Fotosut provides a comprehensive photography studio management platform that includes:

  • Client relationship management
  • Project and photo management
  • Booking and scheduling system
  • Invoice generation and payment processing
  • Photo gallery creation and sharing
  • AI-powered assistant (Nova) for photography-related queries

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice.

4. Subscription and Payment

4.1 Pricing

Fotosut offers various subscription plans. Pricing details are available on our website and may be updated from time to time. We will provide advance notice of any price changes.

4.2 Payment Terms

  • Subscriptions are billed in advance on a recurring basis
  • Payment is processed securely through Stripe
  • You authorize us to charge your payment method for all fees
  • Failed payments may result in service suspension
  • All fees are non-refundable except as required by law

4.3 Free Trial

We may offer a free trial period. If you do not cancel before the trial ends, you will be automatically charged for the selected subscription plan.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. You will retain access to the service until that date.

5. User Content

5.1 Your Content

You retain all ownership rights to the content you upload to Fotosut, including photos, client information, and other data ("Your Content"). By uploading Your Content, you grant us a limited license to store, process, and display it solely for the purpose of providing our services.

5.2 Content Responsibility

You are solely responsible for Your Content and warrant that:

  • You have all necessary rights to upload and share Your Content
  • Your Content does not violate any laws or third-party rights
  • Your Content does not contain malware or malicious code
  • You have obtained necessary model releases and permissions

5.3 Content Restrictions

You agree not to upload content that:

  • Is illegal, harmful, threatening, abusive, or hateful
  • Infringes on intellectual property rights
  • Contains explicit or adult content without proper age verification
  • Violates privacy rights of others
  • Contains spam or unsolicited promotional material

5.4 Content Backup

While we implement backup procedures, you are responsible for maintaining your own backup copies of Your Content. We are not liable for any loss or corruption of Your Content.

6. Prohibited Activities

You agree not to:

  • Use the service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service or servers
  • Use automated systems to access the service without permission
  • Reverse engineer or attempt to extract source code

The Fotosut platform, including its design, features, and underlying technology, is owned by Fotosut and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without express written permission.

8. Third-Party Services

Fotosut integrates with third-party services including Stripe (payments), Cloudinary (media storage), OpenAI (AI features), and others. Your use of these services is subject to their respective terms and conditions. We are not responsible for the actions or policies of third-party services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOTOSUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Indemnification

You agree to indemnify and hold harmless Fotosut and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service, Your Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the service will immediately cease, and we may delete Your Content.

You may terminate your account at any time by contacting us or through your account settings. Termination does not relieve you of your obligation to pay any outstanding fees.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the service shall be resolved through binding arbitration, except where prohibited by law.
